Scope Of Services

BAPMI provides out-of-court dispute settlement services upon disputing party's request to BAPMI. However not all of disputes can settle through BAPMI, it shall meet following criteria's:

1. only dispute on civil case in connection with capital market activity;
2. there is an agreement between disputing parties that such dispute will referred to BAPMI;
3. there is a written request by the disputing party to BAPMI;
4. such dispute is not a criminal or administrative case, such as market manipulation, insider trading, or revocation of business license.

BAPMI provides 3 mechanisms of alternative dispute resolution to the disputing parties: Binding Opinion, Mediation, and Arbitration.

In performing its function as an institution for alternative dispute settlement, BAPMI ensures its neutrality and independency at all the times. There is no one can be allowed as an Arbitrator or Mediator if he/she having an affiliation relationship with one of the parties. If such relationship has known later, then he/she must replace with other person, which is more independent.
