& Fees
The kind of Arbitration Costs
Each of disputes referred to BAPMI's Arbitration shall be subject to the costs and fee stipulated by BAPMI:
- Registration Cost:
this cost shall have been fully paid at the time request for the Arbitration is submitted to BAPMI.
- Examination Costs:
these costs will be calculated based on the real expenses incurred during case examination process, such as: rent of hearing room, transportation cost and accommodation for witnesses/expert witnesses, cost for local examination. The costs shall be paid before the examination began.
- Service Fee:
this is a fee for using BAPMI's Arbitration service. This fee shall be paid by the parties before Arbitrator issued the decision. The amount of fee is determined based on the sum of claim.
Who will borne Arbitration Costs
Unless otherwise expressly specified by the parties's agreement, the amount of Arbitration costs and fee will be borned to the parties according to the following provisions:
- if the claim is sustained in its entirety, Arbitration cost and fee shall be on the account of and paid by the Respondent;
- if the claim is overruled, Arbitration cost and fee shall be on the account of and paid by the Applicant;
- if the claim is partly sustained, Arbitration cost and fee will be divided between the Parties by a proportion deemed just and fair by the Arbitrator.
