Registration of Application of BAPMI's Arbitration

The disputing parties that bound to Arbitration agreement and need to settle their dispute through BAPMI's Arbitration shall submit a written application to BAPMI, attn. the Chairman, and addressed to BAPMI's office. The written application can submit by one of disputing parties.

The party who submit application was called "Claimant", or similar with "Plaintiff" in litigation. In the other side, the counter party was called "Respondent", or similar with "Defendant" in litigation.

Content of the Application

The party that will submit the application for Arbitration shall specified all of the following information in the application:

1. the Arbitration Agreement between the parties, either made prior to the dispute or after the dispute arises;
2. the full name, residence or domicile of the parties;
3. detailed description of the issue being the object of the dispute;
4. the relevant agreements/documents forwarded by the Claimant;
5. the name of the Arbitrator proposed by the Claimant;
6. a list of the candidate witnesses and/or expert witnesses to be presented;
7. the claim in detail;
8. an express statement of the Claimant that he/she will be bound and will abide by the decision of Arbitrator and that he/she waives any legal actions with respect to the same dispute to the court;
9. payment receipt of registration cost.

Verification by BAPMI's Management

BAPMI's Management verifies:

1. does the application meets all of the administrative requirements;
2. do the parties have an agreement that such dispute will be resolved by BAPMI's Arbitration;
3. is the dispute submitted to BAPMI related to the civil dispute on capital market activity; and
4. do the parties have already paid the Registration Cost.

If the application fulfilled all of requirements as mentioned above, BAPMI's Management will notifies the Claimant within a period of 14 work days after registration that the application are accepted and will be further processed.
