Ethics Tribunal

The Honorary Council receives and examines any complaints with respect to any alleged violation against the Code of Conduct committed by BAPMI's Arbitrators/Mediators as the first and final decision. BAPMI's Management, disputing parties or any other party concerned have a right to submit the complaints to the Honorary Council. Hearing of any complaint will be convened by the Honorary Council in a tribunal in the presence of the complaining party, the complained party, and witnesses.

The decision will be made by the Honorary Council through deliberation to reach consensus or by voting within no later than 30 (thirty) working days as from the date of the first hearing. The decision must set forth the recitals serving as the grounds of such decision and refer to the articles of the Code of Conduct against which the violation is committed. Once after receiving a copy of the decision, the Management will enforce such decision and submit a report to all BAPMI's Members and Chairman of Indonesian Capital Market Supervisory Agency (BAPEPAM) regarding such decision and any actions taken.

If BAPMI's Arbitrator/Mediator proved to have no committed violation against the Code of Conduct, he/she may continue his/her duties. In the other hand, sanction or punishment given against the Code of Conduct may be in form of:

  1. verbal or written reminder;
  2. written warning;
  3. temporary suspension as BAPMI Arbitrator/ Mediator;
  4. termination as BAPMI Arbitrator/Mediator.
