Registration

Registration of the Binding Opinion Application

The parties that have an intention to settle their differences by BAPMI's Binding Opinion shall submit the application in writing to BAPMI, attn the Chairman, and addressed to BAPMI's office. Both parties, not only by one party, must submit the application.

Content of Application
The parties that submit the application for Binding Opinion shall specified all of the following information in the application:

  1. agreement of the parties that differences will be settled through BAPMI's Binding Opinion;
  2. detailed description of the differences;
  3. the opinion desired by each parties;
  4. relevant agreements/documents from each parties;
  5. express statement that all parties agree to be bound to the Binding Opinion;
  6. payment receipt of registration cost.

Verification by BAPMI's Management
BAPMI's Management verifies:

  1. does the application meets all of the administrative requirements;
  2. do the parties have an agreement that such differences will be resolved by BAPMI's Binding Opinion;
  3. is the differences submitted to BAPMI related to the civil dispute on capital market activity; and
  4. do the parties have already paid the Registration Cost.

If the application meets all of the requirements as mentioned above, the BAPMI's Management will notify the parties in writing at the latest 7 workdays as of the date of registration that the application accepted and further processed.
